We are launching a new competition. This time, to win a mug with our plumber Arthur, all you need to do is write an original and creative text. Before you start creating, be sure to read the Terms and Conditions below.
Regulations the "mug with ART" competition
- These Rules set out the conditions of participation in the "KUBEK Z ARTURKIEM" competition, hereinafter referred to as the Rules.
- The competition is held in the Republic of Poland, is not a game of chance, fantasy, betting, promotional lottery or any other form of game of chance and will run from 11 March 2022 until 31 March 2022.
- The organiser of the competition "KUBEK Z ARTURKIEM", hereinafter referred to as the Competition, is "Cetel Serwis" sp. z o.o. with its registered office in Głuchów, 16 Komornicka Street, registered in the Register of Entrepreneurs run by the District Court Poznań - Nowe Miasto and Wilda in Poznań, VIII Economic Department of the National Court Register under the KRS number 0000102015, with the share capital of PLN 300,000.00, NIP: 7791018967, REGON: 630363901.
- The Participant of the Competition is a person having full legal capacity. Employees of the Organiser and entities involved in the preparation of the Competition, as well as their descendants, ascendants, siblings, spouses, persons in a relationship of adoption or actual cohabitation with these persons, cannot participate in the Competition as Participants. Participation in the Competition is entirely voluntary.
- The aim of the Competition is to encourage the Customers of Wholesale Installations Company "Cetel Serwis" sp. z o.o. to write a creative text of their own authorship, hereinafter referred to as the Competition Work. The organiser intends to use the selected texts for printing on company mugs at a later date.
- Participation in the Competition and the related provision of personal data is voluntary. In order to participate in the "MUG WITH ARTURK" Competition, it is necessary to:
a) making a signed application by sending an e-mail to konkurs@cetel.pl with the contents completed with the personal data indicated:
"I declare my participation in the "MUG WITH ARTURK" Competition.
I declare that I have read the Rules and Regulations of the Competition for the most interesting text, which I accept and undertake to abide by.
I indicate my personal data:

necessary for the transfer of the prize obtained in the competition from "Cetel Serwis "Sp. z o.o. and I agree that the Organiser may transport my personal data in this regard."
b) to accept the Rules of the competition, which are available on the Organiser's website https://blog.cetel-hurtownia.pl/.
c) submitting to the Organiser a statement on the transfer of copyright to the Competition Work,
(d) submitting consent to the Organiser for the processing of personal data,
(e) the granting of the above consents and the transfer of rights is entirely voluntary, but failure to do so will prevent you from taking part in the Competition,
f) the production of a creative text of your own authorship on a theme related to the work of a plumbing and gas fitter,
g) a statement by the Competition Participant that the Competition Work submitted by him/her does not contain any content that violates the law or is contrary to good morals, and in particular does not infringe the rights of third parties,
(h) send the above statements together with the competition text to: konkurs@cetel.pl until 18 March 2022.
(i) writing the competition text in a comment of the competition post dated 11 March 2022 on the Organiser's profile:
https://www.facebook.com/hurtownia.instalacyjna - Facebook is fully indemnified by each participant. The promotion is also in no way sponsored, endorsed or conducted by or associated with Facebook.
- COMPETITION WORK - is an idea for a text (song) that:
(a) will be drawn up and recorded in electronic form,
(b) is a saying with a theme that relates to the plumbing profession in the plumbing and gas industry,
(c) is innovative, meaning that the text is a new, unique and creative work,
(d) has not previously been implemented,
(e) one Contest Entrant may write one text. - STAGES OF THE COMPETITION:
a) 11 March - 18 March 2022
Participants send their application to the competition together with the statements from point accepting at the same time these Regulations. By that time, Participants must at the same time comply with the conditions of participation contained in point 6 of these Regulations.
b) 21 March 2022
The organiser makes the following available in a post on his facebook.com/hurtownia.instalacyjna profile and on his website
https://blog.cetel-hurtownia.pl/ the list of Participants by indicating the first name and the first letter of the surname, whose texts have been selected for prizes by the Organiser.
(c) from 21 to 31 March 2022
The Organiser of the Competition undertakes to provide the selected Participants with the texts of the prizes. The transfer of prizes will take place according to the place of residence indicated by the Participant in the application form. - AWARDS
The prizes in the 'KUBEK WITH ARTURK' Competition come in the form of company mugs with a graphic of a plumber in white,
with a capacity of 300 ml, in a quantity of 10 pieces. The organiser envisaged awarding one winner with one mug.
a) The selection of the winning prize-winners will be made by the Competition Committee (hereinafter referred to as the Committee) at its subjective discretion, consisting of three representatives of the Organiser. A minuted meeting of the Commission will be held on 21 March 2022 at the Organiser's registered office. The tasks of the Commission include in particular: supervising the proper course of the Competition, verifying the submitted entries with regard to meeting the deadline, awarding prizes, conducting complaint proceedings.
(b) The Commission will select the successful candidates taking into account the above criteria. The decision of the Commission is final.
(c) Winners of the Competition shall not be entitled to reserve any special qualities of the prizes or to receive their monetary equivalent. - INTELLECTUAL PROPERTY RIGHTS TO THE COMPETITION WORKS
a) By taking part in the Competition, the Entrant declares at the same time that he/she is the sole author of the Competition Work and that he/she has full proprietary copyrights to the Competition Work together with its photographs. In exchange for the right to participate in the Competition, the Organiser acquires from the Entrant the right to use, on a transfer basis, all property rights to the Competition Work in order to conduct the Competition. The Participant transfers respectively the author's economic rights to the above work in all fields of exploitation, as well as the dependent rights to the above work to the Organiser, including in particular:
- fixation and reproduction by any technique (in any system, format and medium), including, but not limited to, print, photographic film, magnetic tape, digital,
- marketing,
- input to computer memory, to a computer and/or multimedia network, to databases,
- making available to the public in such a way, at such a place and at such a time as he or she chooses (including, but not limited to, making available on the Internet, as well as within the framework of any telecommunications services using any systems and devices),
- display, display,
- analogue and digital broadcasting of vision and/or sound (whether encoded or unencoded, whether or not free of charge, in any system, format or technology) by wire or wireless over a terrestrial station and by satellite, inter alia via digital platforms, cable networks, telecommunications connections, mobile TV, IPTV, DSL, ADSL, any computer network (including the internet), etc,
- re-broadcasting of analogue and digital video and/or audio (encoded or unencoded, whether paid or unpaid, in any system, format or technology) by means of, inter alia, digital platforms, cable networks, telecommunications connections, mobile television, IPTV, DSL, ADSL, any computer network (including the Internet),
- in all other forms of communication, promotion, advertising, labelling and production of goods.
(b) The Participant agrees to the anonymous dissemination of the aforementioned works by the Organiser.
c) Upon handing over the Competition Work or its description respectively, the Organiser acquires full copyrights and subsidiary rights and ownership of the copies of these works respectively, without any territorial or quantitative restrictions.
d) If necessary, the Entrant will, at the request of the Organiser, sign appropriate statements or agreements confirming the transfer of copyrights to the awarded Competition Works. - PERSONAL DATA
a) The Administrator of the personal data of the Contest Participants is "Cetel Serwis" sp. z o.o. Komornicka 16 Street, Głuchowo, e-mail: konkurs@cetel.pl tel. 512 285 123. The Administrator processes the personal data provided by the Participants in the application of the Contest Work (i.e. name and surname, town, address, e-mail address, telephone number, as well as the personal data provided in connection with submitting a complaint or the data needed to transfer the prize money to the Participant).
(b) The controller processes personal data to the extent necessary to fulfil the purpose, which is:
- the proper execution of the Competition (its organisation and conduct) in accordance with the Regulations, and in particular to provide Participants with the opportunity to participate in the Competition - the basis for the processing of personal data is the Participant's voluntary consent in accordance with - Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: "RODO");
- the fulfilment of the Organiser's/Administrator's legitimate interest, the amicable resolution of a possible dispute, the defence against directed claims and the processing of complaints,
- fulfilment of tax obligations - on the basis of Article 6(1)(c) of the RODO.
c) The provision of personal data by the Entrant in the Application is voluntary, but necessary in order to take part in the Competition or to realise the Prize in the Competition respectively. The provision of personal data by the Entrant in the body of the complaint is also voluntary, but necessary for the Organiser to process the complaint. The provision of data by the Participant needed to transfer the prize money to the Participant is also voluntary, but necessary to transfer the prize.
(d) The controller will process personal data for the following periods:
- the data of the Competition Participants - no longer than 6 months after the expiry of the period for handling complaints and resolving possible disputes,
- the data of the winners of the Prize in the Competition - not longer than 5 years from the date on which the tax obligation arises, or until the statute of limitations for claims, whichever is later.
e) The Controller may subcontract to other entities acting on behalf of the Controller - to the extent that this is necessary for the purposes of the processing of such data.
(f) The participant has the right at any time to:
- to confirm that their personal data is being processed, to access their data and to obtain a copy of their data,
- correct inaccurate personal data or complete incomplete personal data,
- request the erasure or restriction of the processing of personal data - whereby the request will be met if the requirements set out in Articles 17 and 18 of the RODO are met,
- portability of personal data,
- objections,
- to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal (insofar as the data is processed on the basis of Article 6(1)(a) of the RODO).
g) In order to obtain information on the processing of their personal data and to exercise their rights, data subjects should make an enquiry to the Controller, who should be contacted by email by sending an email to: konkurs@cetel.pl.
h) Data subjects have the right to lodge a complaint with the President of the Office for the Protection of Personal Data, 2 Stawki Street, 00 -193 Warsaw - in the event that personal data is found to be processed unlawfully. - PRINCIPLES OF THE COMPLAINTS PROCEDURE
a) Complaints about the running of the Competition can be made by e-mail to konkurs@cetel.pl.
b) The complaint should contain the name, surname and address of the Competition Participant, as well as a detailed description and indication of the reason for the complaint.
(c) Complaints are dealt with by the Organiser within 14 days of submission.
d) The Organiser's decision regarding the complaint is final and binding. The Competition Participant will be notified of the Organiser's decision by e-mail within 7 days from the date of consideration of the complaint. - FINAL PROVISIONS
a) In matters not covered by these Regulations, the provisions of the Civil Code shall apply.
b) The Contest Participant may resign from the Contest at any time by submitting a statement to the Organizer's e-mail address. konkurs@cetel.pl. In the event of withdrawal from the Competition, the Organiser will immediately delete the personal data of the person withdrawing from the Competition made available only for the purposes of the Competition.
c) In the event of an infringement of the Rules by an Entrant in the Competition, the Organiser shall be entitled to exclude that Entrant from the Competition.
(d) The rights arising from participation in the Competition cannot be transferred by the Participant to a third party.
(e) The Competition is in no way sponsored, endorsed or carried out by or affiliated with Facebook. Accordingly, each Entrant fully releases Facebook from any and all liability in connection with the Competition.
(f) The Regulations shall come into force on 11 March 2022.
