Today is International Firefighters' Day! On this occasion we have a competition for you, in which your creativity counts. We are looking forward to receiving interesting photos related to the work of firefighters. Be sure to read the competition rules.
Regulaments of the "firefighter's day" competition
These Terms and Conditions set out the terms and conditions of participation, rules and duration of the "DAY OF THE FIREFIGHTER" competition (Competition) on the social network facebook.com.
(1) The Competition shall be held in the Republic of Poland, is not a game of chance, fantasy, betting, promotional lottery or any other form of game of chance and shall run from 04 May 2022 to 20 May 2022.
The organiser of the competition "DAY OF THE FIREFIGHTER", hereinafter referred to as the Competition, is "Cetel Serwis" sp. z o.o. with its registered office in Głuchów, 16 Komornicka Street, registered in the Register of Entrepreneurs run by the District Court Poznań - Nowe Miasto and Wilda in Poznań, VIII Economic Department of the National Court Register under the KRS number 0000102015, with the share capital of PLN 300,000.00, NIP: 7791018967, REGON: 630363901.

4 Facebook is fully indemnified by each participant. Nor is the promotion in any way sponsored, endorsed or conducted by or associated with Facebook.
The Participant of the Competition is a person who has full legal capacity. Employees of the Organiser and entities involved in the preparation of the Competition, as well as their descendants, ascendants, siblings, spouses, persons in a relationship of adoption or actual cohabitation with these persons, cannot participate in the Competition as Participants. Participation in the Competition is entirely voluntary and free of charge.
(6) Before entering the Competition, the Entrant should read the Terms and Conditions. By submitting an entry form, the Entrant indicates his/her willingness to participate in the Competition under the terms of the Rules.
The aim of the competition is to encourage the Customers of Wholesale Installations Company "Cetel Serwis" sp. z o.o. to take a creative photo of their own authorship, hereinafter referred to as the Competition work. The Organiser intends to later use the selected photos for presentation on the blog (https://blog.cetel-hurtownia.pl/) and/or its social networks (Facebook, Instagram). The Participant may not influence the outcome of the Competition in a manner contrary to the law or good morals. The Organiser has the right to exclude from the Competition a person who, or whose entry, does not meet the requirements set out in these Rules. Should a person who had grounds for his/her exclusion from the Competition in accordance with the provisions of the above paragraph become a Winner, he/she loses his/her right to the Prize. In such a situation, the Selection Committee shall reconvene and select a new Winner.
8 Participation in the competition and the related provision of personal data is voluntary. In order to participate in the "Fireman's Day" competition it is necessary:
a) Posting under the competition post a creative photo of yourself and depicting yourself with reference to the work of firefighters / showing yourself and your work as a firefighter.
b) Placing under the Contest post together with the photo a note "I hereby declare that I have read the Regulations of the Contest "Fireman's Day", which I accept and undertake to abide by its provisions. I agree to use my image in the Contest and to use it together with the work (Contest Work) in accordance with the Regulations.
c) making a signed application by sending an e-mail to konkurs@cetel.pl with the contents completed with the personal data indicated:
"I hereby declare my participation in the Fireman's Day Competition. I declare that I have read the Rules and Regulations of the Competition for the most interesting photo, which I accept and undertake to comply with its provisions. I indicate my personal data: name and surname: e-mail: necessary for the transfer of the prize obtained in the competition from "Cetel Serwis "Sp. z o.o. and I agree that the Organiser may transport my personal data in this respect."
d) submitting to the Organiser a declaration on the transfer of copyright to the Competition Work,
(e) submitting consent to the Organiser for the processing of personal data,
(f) the granting of the above consents and the transfer of rights is entirely voluntary, but failure to do so will prevent you from taking part in the Competition,
g) a statement by the Competition Participant that the Competition Work submitted by him/her does not contain any content that violates the law or is contrary to good morals, and in particular does not infringe the rights of third parties,
(h) sending the above statements to: konkurs@cetel.pl by 20 May 2022.
i) The competition entry, a photograph, will only be accepted in digital form,
(j) The photograph can be taken with a camera, tablet or smartphone,
9. COMPETITION WORK - is a photo idea that:
(a) will be drawn up and recorded in electronic form,
(b) is a photograph on a theme related to the work of a firefighter,
c) is innovative, meaning that the photo is a new, unique and creative work,
(d) has not been previously implemented,
(e) A maximum of one Competition Entry may be posted in a single comment. A participant may submit any number of entries to the Competition - the number of entries will not affect the selection of the winners.
10. STAGES OF THE COMPETITION
(a) 04 May 2022 - 20 May 2022
Entrants shall send an entry to the competition together with the declaration set out in point b) of paragraph 8 of these Rules.
b) 23 May 2022
The organiser makes the following available in a post on his profile facebook.com/wholesale.installation and on https://blog.cetel-hurtownia.pl/ a list of the Winners by indicating the first name and first letter of the surname whose photos have been selected by the Organiser for the prizes.
(c) 23 May 2022
The winners of the competition will be informed by the Organiser of the Prize via Facebook on the day the Winners are announced.
If the Organiser is unable, for any reason, to contact the Winner of the Competition, or does not receive a response to the notification of winning within 7 days of sending the notification together with the information needed to transfer the Prize as set out in Clause 8 of these Rules, the Organiser reserves the right to award the Prize to another participant.
11. AWARDS
Prizes in the "DAY OF THE FIREFIGHTER" Competition are in the form of vouchers with a code worth PLN 200, in the number of 5 units, entitling to reduction of the sum of purchases in the https://www.cetel-hurtownia.pl/ shop by the above amount. The voucher can be used until December 31, 2022. The Organiser plans to award one Winner with one Voucher.
a) The selection of the winning prize-winners will be made by the Competition Committee (hereinafter referred to as the Committee) at its subjective discretion, consisting of three representatives of the Organiser. A minuted meeting of the Commission will be held on 20 May 2022 at the Organiser's registered office. The tasks of the Commission include in particular: supervising the proper course of the Competition, verifying the submitted entries with regard to meeting the deadline, awarding prizes, conducting complaint proceedings.
(b) The Commission will select the successful candidates taking into account the above criteria. The decision of the Commission is final.
(c) Winners of the Competition shall not be entitled to reserve any special qualities of the prizes or to receive their monetary equivalent.
(d) participation in the Competition, as well as the rights and obligations associated with it, including the right to claim the prize, are not transferable.
12. intellectual property rights for competition entries
a) By taking part in the Competition, the Entrant declares at the same time that he/she is the sole author of the Competition Work and that he/she has full proprietary copyrights to the Competition Work. In exchange for the right to participate in the Competition, the Organiser acquires from the Participant the right to use, on a transfer basis, all property rights to the Competition Work in order to conduct the Competition. The Participant transfers accordingly the author's economic rights to the above work in all fields of exploitation, as well as the dependent rights to the above work to the Organiser, including in particular:
- fixation and reproduction by any technique (in any system, format and medium), including, but not limited to, print, photographic film, magnetic tape, digital,
- marketing,
- input to computer memory, to a computer and/or multimedia network, to databases,
- making available to the public in such a way, at such a place and at such a time as he or she chooses (including, but not limited to, making available on the Internet, as well as within the framework of any telecommunications services using any systems and devices),
- display, display,
- analogue and digital broadcasting of vision and/or sound (whether encrypted or unencrypted, whether free of charge or not, in any system, format or technology) by wire or wireless over a terrestrial station and by satellite, inter alia via digital platforms, cable networks, telecommunications connections, mobile TV, IPTV, DSL, ADSL, any computer network (including the internet), etc,
- re-broadcasting of analogue and digital video and/or audio (encoded or unencoded, whether or not for payment, in any system, format or technology) by means of, inter alia, digital platforms, cable networks, telecommunications connections, mobile television, IPTV, DSL, ADSL, any computer network (including the Internet),
- in all other forms of communication, promotion, advertising, labelling and production of goods.
(b) The Participant agrees to the anonymous dissemination of the aforementioned works by the Organiser.
c) Upon handing over the Competition Work or its description respectively, the Organiser acquires full copyrights and subsidiary rights and ownership of the copies of these works respectively, without any territorial or quantitative restrictions.
d) If necessary, the Entrant will, at the request of the Organiser, sign appropriate statements or agreements confirming the transfer of copyright in the awarded Competition Works.
13. Personal data
a) The Administrator of the personal data of the Contest Participants is "Cetel Serwis" sp. z o.o. Komornicka 16 Street, Głuchowo, e-mail: konkurs@cetel.pl tel. 512 285 123. The Administrator processes the personal data provided by the Participants in the application of the Contest Work (i.e. first and last name,
town, address, e-mail address, telephone number, as well as personal data provided in connection with the lodging of a complaint or data needed to transfer the prize money to the Participant).
(b) The controller processes personal data to the extent necessary to fulfil the purpose, which is:
- the proper execution of the Competition (its organisation and conduct) in accordance with the Regulations, and in particular to provide Participants with the opportunity to participate in the Competition - the basis for the processing of personal data is the Participant's voluntary consent in accordance with - Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: "RODO");
- the fulfilment of the Organiser's/Administrator's legitimate interest, the amicable resolution of a possible dispute, the defence against directed claims and the processing of complaints,
- fulfilment of tax obligations - on the basis of Article 6(1)(c) of the RODO.
c) The provision of personal data by the Entrant in the Application is voluntary, but necessary in order to take part in the Competition or to realise the Prize in the Competition respectively. The provision of personal data by the Entrant in the body of the complaint is also voluntary, but necessary for the Organiser to process the complaint. The provision of data by the Participant needed to transfer the prize money to the Participant is also voluntary, but necessary to transfer the prize.
(d) The controller will process personal data for the following periods:
- the data of the Competition Participants - no longer than 6 months after the expiry of the period for handling complaints and resolving possible disputes,
- the data of the winners of the Prize in the Competition - not longer than 5 years from the date on which the tax obligation arises or until the statute of limitations for claims, whichever is later.
e) The Controller may entrust other entities acting on behalf of the Controller - to the extent that this is necessary for the purposes of the processing of these data.
(f) The participant has the right at any time to:
- to confirm that their personal data is being processed, to access their data and to obtain a copy of their data,
- correct inaccurate personal data or complete incomplete personal data,
- request the erasure or restriction of the processing of personal data - whereby the request will be met if the requirements set out in Articles 17 and 18 of the DPA are met,
- portability of personal data,
- objections,
- revoke consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before revocation (insofar as the data is processed on the basis of Article 6(1)(a) of the RODO).
g) In order to obtain information on the processing of their personal data and to exercise their rights, data subjects should make an enquiry to the Controller, who should be contacted by email by sending an email to: konkurs@cetel.pl.
h) Data subjects have the right to lodge a complaint with the President of the Office for the Protection of Personal Data, 2 Stawki Street, 00 -193 Warsaw - in the event that personal data is found to be processed unlawfully.
14 Complaint procedure rules
a) Complaints about the running of the Competition can be made by e-mail to konkurs@cetel.pl.
b) The complaint should contain the name, surname and address of the Competition Participant, as well as a detailed description and indication of the reason for the complaint.
(c) Complaints are dealt with by the Organiser within 14 days of submission.
d) The Organiser's decision regarding the complaint is final and binding. The Competition Participant will be notified of the Organiser's decision by e-mail within 7 days from the date of consideration of the complaint.
15. Final provisions
a) In matters not covered by these Regulations, the provisions of the Civil Code shall apply.
b) The Competition Participant may resign from the Competition at any time by submitting a statement to the Organiser's e-mail address konkurs@cetel.pl. In the event of resignation from the Competition, the Organiser will immediately delete the personal data of the person resigning from the Competition made available only for the purposes of the Competition.
c) In the event of an infringement of the Rules by an Entrant in the Competition, the Organiser shall be entitled to exclude that Entrant from the Competition.
(d) The rights arising from participation in the Competition cannot be transferred by the Participant to a third party.
(e) The Competition is in no way sponsored, endorsed or carried out by or affiliated with Facebook. Accordingly, each Entrant fully releases Facebook from any and all liability in connection with the Competition.
(f) The Regulations shall come into force on 04 May 2022.
